STROKE MALPRACTICE
Understanding Stroke Malpractice
Common Types of Strokes Malpractice
Stroke malpractice occurs when medical professionals fail to properly diagnose or treat a stroke, leading to severe consequences, included permanent paralysis, paraplegia, hemiplegia, quadriplegia, dysp. Strokes require immediate medical attention, and any delay or error in treatment can result in permanent disability or even death. Understanding when stroke malpractice is prevalent is crucial in recognizing the rights of the patient and their family, especially when these errors are preventable.
Medical emergencies are an unfortunate part of life. Fortunately, technology has advanced to the point where permanent injury from a medical emergency can be avoided with appropriate and timely medical care. When a medical emergency occurs, it is important for healthcare providers to timely and accurately diagnose the emergency so that immediate, often life-saving, treatment can be initiated. A healthcare providers’ failure to timely and accurately diagnose a medical emergency may be negligent. One such medical emergency is stroke. Strokes are of either ischemic or hemorrhagic origin. With an ischemic stroke, there is a blockage in the blood vessels that feed the brain with oxygen rich blood. With a hemorrhagic stroke, there is a defect, leak or other tear in the blood vessels that causes blood to leak out of the vasculature and into the brain cavity. Ischemic strokes are far more common that hemorrhagic strokes. With either type of stroke, a loss of oxygen-rich blood to any area of the brain requires immediate medical and/or surgical treatment in order to prevent permanent and catastrophic brain injury. When a doctor fails to timely and accurately diagnose a stroke, permanent harm can occur to the individual that has lasting effecting, including paralysis, quadriplegia, seizures, speech deficits, facial droop, inability to self feed, among others.
The spinal cord, much like the brain, can infarct (i.e., suffer a stroke). When you seek out and receive healthcare, you trust that your providers will perform a thorough physical examination and consider all potential causes of your symptoms, especially those that can progress and cause permanent, irreversible, harm. When the spinal cord suffers an infarct, a person may experience catastrophic injury, including, permanent paralysis of the arms and/or legs, inability to walk, bowel incontinence, and urine incontinence, among other injuries.
The Impact on Victims and Families
The impact of stroke malpractice is profound, affecting both the patient and their loved ones. Patients may suffer from increased physical disability, loss of independence, and significant emotional trauma. Families often face the burden of increased caregiving responsibilities and financial strain due to medical expenses and loss of income. Medical negligence as the cause of these challenges only deepens the sense of injustice.
Why Legal Action is Important
Pursuing legal action in stroke malpractice cases goes beyond financial compensation. It is about seeking justice for the patient and holding healthcare providers accountable for their actions. Legal action can help secure the resources necessary for ongoing medical care, rehabilitation, and support services, aiding in the patient's long-term recovery and quality of life.
